Nirbhaya: Case Of Death Penalty Alone Submits Prosecution; Amicus Hegde Files Rejoinder [Read the Submission]

Just before the Supreme Court reserved its verdict recently, the prosecution in the sensational Nirbhaya rape and murder case has submitted before the special bench of the Supreme Court headed by Justice Dipak Misra that four death row convicts Mukesh (24), Pawan (20), Vinay (22) and Akshay (29) do not deserve any leniency and only confirmation of capital punishment would meet the ends of justice given the “diabolical nature, brazenness and brutality” of the crime. Senior Advocate Sidharth Luthra has filed the written submissions on this.

But Amicus curiae Senior Advocate Sanjay Hegde has filed a rejoinder on the following aspects

  1.  Inconsistencies in the evidence of PW-1
  2.  Inconsistencies in the Dying Declarations made by the Prosecutrix
  3.  Unreliability of PW-82, Ram Adhar
